Full Breakdown
Section 12-33 governs mobile food vendors in Jacksonville Beach where the zoning districts allow them. The local business tax receipt is the city's permit step. Section 12-33(5)(a) says that, in accordance with F.S. § 509.102, a separate local license and/or permit is not required to operate a mobile food dispensing vehicle. Subsection (5)(b) then requires an annual City of Jacksonville Beach local business tax receipt for each vending location, applied for, paid for and issued before engaging in any business or commercial activity. A copy must be clearly displayed on the vehicle and renewed annually.
To get the receipt, the vendor gives the city clerk a mobile food dispensing vehicle application packet and evidence of all applicable zoning approvals and State of Florida licenses and permits. The list includes the Department of Business and Professional Regulation MFDV license, the Florida Department of Health license, Department of Highway Safety and Motor Vehicles driver licenses for the applicant and all authorized drivers, and a City of Jacksonville Beach Fire Marshal fire safety inspection report showing code compliance with NFPA 1-50.7 and NFPA 96.
The application itself, under subsection (6), asks for applicant and owner contact details, the foods to be sold and proposed hours, a color photograph of the vehicle, vending location and property owner information, a scaled site plan, the storage address, copies of state permits, a commissary agreement, a notarized property owner affidavit, proof of business insurance, the Fire Marshal report and the tax receipt form.
Location rules apply too. Vehicles are allowed on lots of six thousand (6,000) square feet or more with a principal building or use in the C-1, C-2, CS, CBD and I-1 districts and certain PUD and RD districts. One vendor is allowed on lots from 6,000 to 43,559 square feet, and two on lots of 43,559 or more. Vehicles must stay one hundred (100) feet from an eating establishment's main entrance and outdoor dining area during its normal hours, and fifteen (15) feet from a fire hydrant. Operating hours run from 7:00 a.m. to 3:00 a.m., or 7:00 a.m. to 10:00 p.m. within one hundred fifty (150) feet of a residential dwelling unit's property line.
Violations & Fines
Under section 12-33(7), inspections can be made at any time by code enforcement inspectors, building code inspectors, the fire marshal or police officers. Noncompliance brings a notice of violation to the lot owner and the vendor, referred to the special magistrate under Chapter 2, Article VI. If Florida revokes or suspends the state permit, the local tax receipt is revoked or suspended too, and reapplication is barred for ninety (90) days.
