The license application goes to the Department of Public Safety and must list the applicant's name and five-year residence and business history, a New York State sales tax number, three two-inch-by-two-inch photographs of each principal, a record of prior criminal convictions, and any pending lawsuits. Vehicle applications need the registration and insurance card. If the applicant handles food, the Town Clerk withholds the license until the operator proves compliance with the Suffolk County Public Health Ordinance, and a food truck applicant must also comply with Chapter 164, Article XXXII of the Town Code.

The Department of Public Safety reviews the file; if it finds a material misrepresentation or a disqualifying conviction it reports to the Town Clerk, who must approve or deny within 30 days of a completed application. A denied applicant already operating in Town must shut down within 15 days, but can ask the Town Board to review the denial. Approved licenses must be affixed to the vehicle where they are clearly visible from the street. Food trucks, ice cream trucks and coffee trucks working a Town Board-approved special event are exempt from the license while operating only at that event and only during its scheduled dates.

The Town Board can revoke a license after notice and hearing for fraud, misrepresentation, any violation of the article, a disqualifying conviction, or conduct that endangers public health or safety.
