Smithtown, NY Parking Rules: Commercial & Oversized Vehicles (2026)

Section 322-12N applies in every district. The use must be clearly accessory and incidental to a principal use with site plan approval; anything else is classified instead as a trucking station, a separate use category with its own review. No repair, maintenance or other service can happen on-site unless it's a filling station, repair garage or trucking station, and the parking or storage can't sit in a required front yard, buffer, landscaping strip, parking space, aisle, sidewalk or planting strip. Large commercial vehicles specifically can't be parked or stored within 100 feet of any residence district.

In the CF, PB and OB Districts and in residence districts, the rules tighten further: no large commercial vehicle may be parked or stored overnight at all, and only one smaller commercial vehicle may be kept overnight, provided it carries no commercial sign affixed or painted on it. In the Town's commercial and industrial districts, Section 322-12N(3) caps the number allowed on a site by building size: one per 7,500 square feet of gross floor area in the CB, NB and SCB Districts, one per 250 square feet in the WSI and HI Districts, and one per 1,500 square feet in the LI District.
