San Marcos Code of Ordinances Sec. 18.161(d)-(e), part of the Peddlers and Solicitors article, makes it unlawful to sell or offer to sell any merchandise from a wagon, cart, pushcart, or other receptacle while standing on the public square, streets, alleys, or sidewalks, and separately bans pursuing the business of a seller or vendor in those same public rights-of-way. Mobile food units are instead permitted to operate from private property under the city's separate food establishment permitting rules in Chapter 18, Article 3.
