30(1) of the City of Middleton Municipal Code regulates what it calls a Garage or Estate Sale (Auction), defined as any temporary display of used household goods for sale on a property customarily used as a residence. The rule caps each sale at four days and limits homeowners to four sales in any twelve-month period, with an added restriction that no more than two sales can occur within any 30-day span, closing the loophole of stringing back-to-back weekend sales together. Unlike many other Temporary Uses in Article III of the Zoning Ordinance, garage sales carry no permit requirement at all, a deliberate exception the City built into a chapter that otherwise requires zoning sign-off for tents, outdoor sales, and vehicle sales.

The only eligibility rule is residency: the person or persons running the sale must actually live at the address where it is held, so a resale business cannot rent out a neighbor's driveway to dodge Middleton's commercial-sales rules. Sales must occur during daylight hours only, ruling out evening or nighttime setups, and any signage advertising the sale still has to comply with Chapter 22 of the Municipal Code, the City's general sign ordinance, which limits temporary sign size, placement, and duration even when the underlying land use itself needs no permit.

Because a Garage or Estate Sale is classified as a Temporary Use under Article III, exceeding the day or frequency caps converts the activity from an exempt temporary use into an unpermitted land use that the Zoning Administrator can cite as a zoning violation.
