A. Designation. Landmark rules are enforced as part of the Planning Code's zoning regulations under Section 17.152.030. Any person who violates a zoning provision, including the landmark Design Review and repair requirements, commits an infraction, with a separate offense for each day the violation continues. A violation charged beyond the third conviction in one year can be prosecuted as a misdemeanor. The city may also treat the violation as a public nuisance subject to summary abatement, seek an injunction, and bill the responsible party for correction, abatement and reinspection costs.
