Under FL ยง720.3085 an HOA has an automatic lien for unpaid assessments, late fees, and attorney costs. Foreclosure requires a 45-day pre-lien notice and then a 45-day pre-foreclosure notice. Interest capped at 18% annually; late fees capped at $25 or 5% of the past-due amount (whichever is greater). Budget must be adopted annually with 14-day notice to members.
