Ashburn and most of Loudoun County are governed by HOAs under the Virginia Property Owners' Association Act (VA Code Β§55.1-1800 et seq.). Board meetings must be open to all members except limited executive sessions. Minutes must be recorded and made available. Annual meetings require 10-day advance notice. The POA Act was significantly updated in 2024 with HB 1209 expanding board assessment authority.
Ashburn is an unincorporated CDP where virtually all residential communities are HOA-governed under the Virginia Property Owners' Association Act (POAA), VA Code Β§55.1-1800 through Β§55.1-1836. All board meetings, including subcommittee meetings where association business is discussed, must be open to members of record. Executive sessions are limited to consultation with legal counsel, discussion of personnel matters, or contract negotiation. Written minutes must be kept and made available to members upon request within 5 business days. Annual meeting notice must be sent at least 10 days but not more than 60 days in advance. Board elections require secret ballots when more candidates run than seats available. The 2024 legislative session (HB 1209, effective July 1, 2024) expanded board authority to levy additional assessments for maintenance and repair of common areas without requiring a full membership vote. Boards must maintain books and records available for member inspection including financial statements, meeting minutes, and governing documents. Virginia's Common Interest Community Board (CICB) within DPOR provides regulatory oversight.
Board actions taken in violation of open meeting requirements may be voidable. Members may petition circuit court under VA Code Β§55.1-1819 for injunctive relief. CICB complaint process available for regulatory violations. Attorney fees may be awarded to prevailing party.
