TX Property Code ยง209.0051 requires that regular and special board meetings of a Texas property owners association be open to members, with 144-hour advance notice for member meetings and 72-hour notice for board meetings (posted or mailed). Executive sessions are permitted only for personnel, litigation, contract negotiations, and individual owner delinquencies. Board actions outside a meeting require unanimous written consent. Minutes must be maintained and available to members for inspection under ยง209.005. HOAs with under 14 lots are partially exempt. McKinney does not override these state rules.
Members may seek a court order compelling compliance and recover attorney's fees under ยง209.008. Individual directors face potential removal.
