Plano HOAs operate under Texas Property Code Chapter 209. Boards must hold open meetings, maintain records for member inspection, and follow notice and voting procedures in governing documents.
Homeowner associations in Plano are governed primarily by Texas Property Code Chapter 209, the Texas Residential Property Owners Protection Act, and by the Texas Business Organizations Code because most Plano HOAs are nonprofit corporations. Under Section 209.0051, board meetings of a property owners association must be open to members except for limited executive sessions involving personnel, legal advice, contract negotiations, or enforcement actions. Boards must give members notice of regular and special meetings as set by the bylaws, and a member is entitled to attend and, subject to reasonable rules, speak at open meetings. Section 209.005 gives owners the right to inspect and copy association books and records, including financial statements, meeting minutes, contracts, and insurance policies, within a reasonable time after a written request, generally 10 business days. The association may charge reasonable copying fees based on Texas Public Information Act rates. Board elections must comply with the HOA's declaration and bylaws, and under Section 209.00593 a majority of owners voting may not be overridden to elect board members except as authorized for developer control periods. Boards adopting fines, architectural decisions, or enforcement actions must follow the procedures in Section 209.006 including written notice, opportunity to cure, and a hearing on request. Violations of these open-meeting and record-access rules can support individual owner suits for injunctive relief under Section 209.008 and may entitle prevailing owners to attorney fees.
