Washington adopted the Uniform Common Interest Ownership Act (WUCIOA), codified at RCW 64.90, effective July 1, 2018 for new associations and available for older associations to opt in. Older condos may still be governed by RCW 64.34 (Washington Condominium Act) and older planned communities by RCW 64.38. WUCIOA requires board meetings to be open to owners with limited executive session exceptions for personnel, litigation, contracts, and delinquency. Boards must provide owner notice of meetings reasonably in advance and keep minutes. Annual meetings of the association are required with owner election of directors. Budgets must be ratified by owners, with rejection requiring a majority vote of the entire membership (not just a quorum), giving boards a strong practical ability to enact budgets. Board members have fiduciary duties of care and loyalty under RCW 64.90.405. Redmond HOAs must also follow their recorded declaration and bylaws. HOA disputes are primarily civil matters between owners and the association; King County Superior Court has jurisdiction for suits.
