Full Breakdown

City ordinance Sec. 14-203-18 flatly overrides private HOA covenants: no community association in Denton can prohibit or restrict a resident's right to install and use a window AC unit on their own property when reasonably necessary for health and safety. Associations may only regulate appearance and off-season use, not ban the units outright. Violators face fines and injunctive relief.

Violations & Fines

Threatening or imposing a fine or lien to enforce a banned restriction, or removing a compliant window AC unit, is a misdemeanor punishable by up to $500 per offense plus injunctive relief.

Frequently Asked Questions

Can my Denton HOA ban window AC units entirely?
No. City Code Sec. 14-203-18 voids any HOA bylaw or CC&R that prohibits window AC units needed for a resident's health and safety.
Can an HOA still regulate how window AC units look?
Yes, but only if the rule doesn't effectively prohibit the units, doesn't limit their operation, and is applied uniformly to all residents.
