California Civil Code sections 5900 through 5965 require every HOA to establish Internal Dispute Resolution (IDR) procedures that allow either party to request a meeting with the board to resolve disputes informally. IDR must be offered at no cost to members and may be requested through a written communication. If IDR fails, Civil Code 5925 through 5965 require Alternative Dispute Resolution (ADR) (typically mediation or arbitration) before either party can file civil action on most association governance disputes. A certificate of compliance with ADR is required when filing a lawsuit. Members are also entitled to request an accounting of fees, inspect records, and bring complaints regarding Open Meeting Act violations.
