Ohio Revised Code Section 3715.01 defines a cottage food production operation as a person who, in their home, produces non-potentially-hazardous foods such as bakery products, jams, jellies, candy, and fruit butter. The Ohio Department of Agriculture requires no license, registration, fee, or inspection for these operations, though products remain subject to sampling for misbranding or adulteration and must carry required labeling. The 'home' must be the owner's primary residence with an ordinary kitchen. This is statewide law and applies uniformly across Lorain County. Local zoning (Lorain's home-occupation standards) still governs where in the home the activity may occur.
Selling potentially hazardous foods, or products that are mislabeled or adulterated, falls outside the exemption and can prompt Ohio Department of Agriculture enforcement.
