Texas Cottage Food Law (Health and Safety Code 437) lets residents sell home-baked and non-hazardous foods. Grapevine cannot prohibit operations but may enforce zoning on traffic and signage.
Texas Cottage Food Law codified at Texas Health and Safety Code Chapter 437 allows individuals to produce and sell non-potentially hazardous foods from their home kitchens, including baked goods, jams, dry mixes, candies, roasted coffee, and certain pickled foods. Grapevine cannot prohibit cottage food production but may enforce other zoning rules limiting customer traffic, signage, and commercial deliveries. Cottage food operators must label products with producer name, address, and a required disclosure that the food is made in a home kitchen not inspected by a state or local health authority. Annual sales are capped by state statute ($50,000 currently). Completion of a food handler course is required. Direct sales to consumers are permitted; wholesale to retail stores is prohibited. Call the Texas DSHS for state permits and Grapevine Planning at (817) 410-3154 for zoning.
