California AB 1616 and AB 1240 allow Class A and Class B Cottage Food Operations to sell approved low-risk foods from a home kitchen after Sacramento County Environmental Management registration. Sacramento County also participates in AB 626 Microenterprise Home Kitchen Operations, expanding allowed home food sales.
California Cottage Food Operations (CFOs) are authorized under Health and Safety Code Sections 113758 and following. Class A CFOs (direct sales only) register with Sacramento County Environmental Management Department; Class B CFOs (indirect sales through retailers) obtain a permit with an inspection. Approved CFO foods include baked goods without cream fillings, jams and jellies, dry spices, granola, and similar shelf-stable items listed by the California Department of Public Health. Annual gross sales are capped at $150,000 per 2022 updates. AB 626 Microenterprise Home Kitchen Operations (MEHKOs) expand permitted home food sales to include meals, and Sacramento County has opted in, allowing MEHKO permits subject to inspection. Standard labeling (ingredient list, address, cottage food license, allergen disclosure) is required.
Operating a CFO or MEHKO without proper registration can trigger county health code enforcement, cease-and-desist orders, and potential misdemeanor charges.
