Cottage Food Operations are allowed in Folsom homes under CA H&S Β§113758 (AB 1616/AB 1240). Class A (direct sales) with registration from Sac County Environmental Management; Class B (indirect/retail) with full permit and inspection. Annual gross sales capped at $150,000. Only approved 'non-potentially hazardous' foods allowed.
California's Cottage Food Law (AB 1616 of 2013, expanded by AB 1240) allows production of specified low-risk foods in a home kitchen with state-defined registration/permit tiers. Sacramento County Environmental Management Department (EMD) administers the program for Folsom residents. Class A (direct sales to end consumer at farmers markets, door-to-door, from home): requires self-certification registration, annual renewal, no kitchen inspection. Class B (indirect sales through retail stores, restaurants, events): full permit, annual home kitchen inspection, food handler card required. Both classes require completion of a food processor training course. Approved foods are 'non-potentially hazardous' items that don't require refrigeration: baked goods without cream filling, candies, jams/jellies, dried fruits, granola, honey, roasted coffee, chocolate-covered nuts, popcorn, dry baking mixes, and more (updated list on CDPH site). Prohibited: any food requiring refrigeration (cheesecakes with dairy, custards, cream pies, fresh salsa). Annual gross revenue limit: $150,000 (increased from $50,000 under AB 1144). Products must be labeled: 'Made in a Home Kitchen' plus producer name, address, registration number, ingredients, allergens, and weight. Microenterprise Home Kitchen Operations (MEHKO) under AB 626 β a separate broader program allowing prepared hot meal sales β is NOT currently active in Sacramento County.
Unregistered/unpermitted operation: cease and desist from Sac County EMD, fines up to $1,000 per violation. Sale of prohibited foods (refrigerated items): public health enforcement. Mislabeled products: recall + fines.
