California state law preempts local regulation of family daycare homes. Per HSC Β§1597.45, small family daycare (up to 8 kids) must be treated as a residential use in all zoning districts. Large family daycare (9-14 kids) must be allowed either by right or through a non-discretionary permit process. Folsom follows state law and does not require a conditional use permit. Operators must obtain a state license through the California Department of Social Services, Community Care Licensing Division, and carry liability insurance per HSC Β§1597.531 ($300,000 per occurrence / $1,000,000 aggregate) or a bond. Fire inspection is required for large family daycares before state licensing is issued. The Folsom Fire Department (50 Natoma Street) conducts these inspections on request. Parking: residential driveway counted toward required spaces. Signage prohibited per standard home occupation rules.
