Full Breakdown
Section 11.32.140(3)h. sets the baseline standard: "The home occupation shall not generate pedestrian or vehicular traffic in excess of that customarily associated with the zone in which the use is located." Table 11.32.140 then converts that standard into numbers. Without any extra permit, personal-service home occupations like barbers or dog grooming are capped at four appointments a day, and instructional services at two students at a time and four lessons a day. Beyond that, an Administrative Use Permit is required once a personal-service business exceeds four appointments a day but stays under 16 vehicle trips a day, or a home occupation generally does not exceed four vehicle trips an hour and no more than 16 vehicle trips a day, business-related, including deliveries. A Minor Conditional Use Permit takes over above that: personal services generating more than 16 but fewer than 32 vehicle trips a day, or a home occupation reaching up to 8 vehicle trips an hour and up to 32 vehicle trips a day.
The table also defines how a trip is counted: "Each vehicle to or from establishment counts as 1 trip (i.e. 2 deliveries to an establishment in 1 day constitutes 4 vehicle trips)." A round-trip delivery therefore counts double. Outside the Valley Growth Boundary, the Minor Conditional Use Permit tier can also authorize other deviations, including sales and display areas over 300 square feet or up to three non-resident employees, where the base standard in § 11.32.140(3)d. otherwise caps home occupation floor area at 25 percent of the dwelling.
Violations & Fines
Generating more customer or delivery traffic than a home occupation's permit tier allows, running an unpermitted business at Administrative or Minor Conditional Use Permit-level trip volumes, is a Development Code violation enforceable under Chapter 11.67 as a misdemeanor or infraction. Zoning clearances for home occupations are not transferable and can be revoked or modified if actual traffic exceeds what was certified, requiring the operator to obtain the higher-tier use permit or scale the business back.
