Full Breakdown

Section 155.111 of the Franklin County Code sorts home occupations into two tracks, and the traffic rules differ sharply between them. A minor home occupation, which Planning staff can approve administratively, must meet the condition in (B)(1)(a)4 that no customers, students or clients are allowed on site. Item 5 adds that the occupation shall not create the need for off-street parking beyond normal dwelling needs and will not generate additional traffic. A tutor, accountant or designer who meets clients in the house therefore cannot qualify as minor.

A major home occupation needs a conditional use permit from the Board of Zoning Adjustments. Under (B)(2)(b), no more than two customers, clients or pupils can be on the site at any one time. The one exception is for an occupant of a single-family dwelling who provides group or professional therapy, which can reach four individuals at one time. Under (B)(2)(c), a major home occupation that accommodates customers, clients or pupils cannot operate between 9:00 p.m. and 7:00 a.m., and (B)(2)(d) keeps the one permitted non-resident employee off the site during the same hours.

Deliveries are capped too. Under (B)(2)(f), deliveries shall not be made using tractor-trailers, and no more than two commercial deliveries, such as UPS, Federal Express or U.S. Postal Service Express Mail, can be made in any 24-hour period. Section 155.111(I) adds that required parking shall not alter the residential character of the lot, and the opening purpose statement in (A) names the goal of preventing an undue increase in traffic or parking problems on local streets. Conditional use approval also depends on the street capacity finding in § 155.105(A).

Violations & Fines

Exceeding the client, hours or delivery limits breaks the conditions of the home occupation permit. Section 155.999(A) sets a fine not to exceed $250 for violating the zoning chapter, including conditions of a conditional use, and each day of non-compliance is a separate offense.

Frequently Asked Questions

Can clients visit my home business in unincorporated Franklin County, Kentucky?
Only under a major home occupation. A minor home occupation allows no customers, students or clients on site. A major one, approved by conditional use from the Board of Zoning Adjustments, allows no more than two at any one time under § 155.111(B)(2)(b).
What are the hours for client visits?
Section 155.111(B)(2)(c) bars a major home occupation that accommodates customers, clients or pupils from operating between 9:00 p.m. and 7:00 a.m. Subsection (d) applies the same hours to any non-resident employee at the site.
How many deliveries can a home business receive?
No more than two commercial deliveries, such as UPS, Federal Express or U.S. Postal Service Express Mail, can be made in any 24-hour period, and none can arrive by tractor-trailer. This is the (B)(2)(f) condition for major home occupations.
Is there an exception for therapy practices?
Yes. Section 155.111(B)(2)(b) lets an occupant of a single-family dwelling provide group or professional therapy for no more than four individuals at one time. Every other major home occupation stays at two customers, clients or pupils.
