Appleton's zoning definitions (Sec. 23-22) split child care into two categories with very different zoning treatment. 'Day care, family' is a use licensed as a day care center by the Wisconsin Department of Health and Family Services where a resident cares for not more than eight children; it is listed as a principal permitted use, allowed by right with no special use hearing, in every single-family and multifamily residential district the code defines: AG, R-1A, R-1B, R-1C, R-2 and R-3 (Secs. 23-91 through 23-96). Because it is its own zoning use category rather than a 'home occupation,' family day care is not subject to the home occupation article's client-visit caps, signage limits or garage-door rules in Sec.

23-45; the state license from the Department of Health and Family Services is the controlling ceiling on how many children can be present. 'Day care, group,' by contrast, is defined as care for nine or more children in a use that is 'not in a private residence,' also licensed by the state; the zoning tables place group day care in the C-2 General Commercial District rather than in any residential district, so a home cannot legally expand past eight children and still operate as a residential use.

A resident who wants to serve a ninth child must either relocate to commercial zoning as a group center or stop taking that child, since Sec. 23-96 and the other residential-district tables never list 'Day care, group' among their permitted or special uses.
