Section 77-29 of the Code of Ordinances defines 'day care center' by headcount: a facility or area providing care, training, education, custody, treatment or supervision for seven or more children for less than 24 hours a day. That numeric floor is the dividing line the zoning ordinance actually uses; the code does not separately define or list a 'day care home' or 'family day care' use for smaller in-home operations below seven children, so a caregiver watching six or fewer children in a residence is not captured by the day care center classification or its use-table entry.

Once a home or business crosses the seven-child line, the schedule of permitted uses at section 77-46(h) takes over: day care center requires a specific use permit (S) in the Agricultural, Estate Development, SF-1, SF-2, SF-3, Two-Family and MF-1 residential districts, and in the Commercial, Light Industrial, Heavy Industrial-1 and Central Area districts, while it is permitted by right (P) in MF-2, Neighborhood Service, General Retail and Highway Commercial districts, and prohibited outright in Heavy Industrial-2. The definition also carves out kindergartens, prekindergartens and schools addressed elsewhere in the chapter, and excludes overnight lodging, medical treatment, counseling and rehabilitative services from the day care center category regardless of headcount.
