Chapter 19.46 of the Roseville Municipal Code sets the location and operating standards for large family day care homes, defined in Section 19.08.080(H) as a dwelling unit where a resident provider cares for seven to 14 children, inclusive, including children under 10 who live at the home, consistent with Health and Safety Code Section 1597.465. Section 19.46.010 states the chapter's purpose is to establish requirements for the location and operation of these homes. Section 19.46.020(A) ties siting to state law: consistent with Health and Safety Code Section 1596.72, a large family day care home may be located in a detached single-family dwelling, a townhouse, a dwelling unit within a dwelling, or a dwelling unit within a covered multi-family dwelling where the underlying zoning allows residential uses.

Section 19.46.020(B) addresses noise from the outdoor play areas that distinguish large day cares from typical households: outdoor play and activity areas may be used only between 8:00 a.m. and 6:00 p.m., and any radio or other electronic amplification device must be kept at a volume that is not audible beyond the exterior boundary of the site. Smaller day care homes, serving eight or fewer children under Section 19.08.080(G), are not subject to this chapter's noise-hour restriction. The Planning Manager enforces Title 19's zoning standards, including Chapter 19.46, under Section 19.90.020, and the City Attorney may prosecute violations. Providers must also hold a state Community Care Licensing Division license to operate legally, independent of the zoning compliance addressed here.
