Sec. 170(A) splits family day care homes into two tiers. A Small Family Day Care Home, serving six or fewer children, needs no permit at all and is not regulated by Title 22. A Large Family Day Care Home, serving seven to 12 children, needs Zoning Clearance approval, or Minor Use Permit approval if a hearing is requested. 46(a)(3); notice goes to owners within 100 feet of the property rather than the standard Minor Use Permit notice radius. The Director must approve the permit once satisfied the facility meets Title 22's requirements and will not generate traffic beyond the safe capacity of the access roads.

Subsection C's concentration standard, which applies to both homes and centers, bars approving a large family day care home within the same block or within 500 feet of another large family day care home or child care center in a residential single-family category, unless a Minor Use Permit specifically authorizes an exception. An off-street drop-off area accommodating at least two cars, beyond the home's normal parking, is required under Subsection E in addition to whatever parking the residence already provides.
