The City of Eagan defines a home business as 'any business or profession by the occupant of a home which is minor and less significant than the residential use of the home, does not change the character of the home, and complies with code requirements.' These standards are part of Eagan's City Code Chapter 11 (Land Use Regulations / Zoning). The use must be 'clearly incidental and secondary to the use of the residence' and 'shall not change the character of the residence.' Staffing is capped: 'No more than three people can be active in the home occupation.' Operations must be 'conducted within the home and not out of a garage or shed, with only the main entrance to the home used.' Parking is limited to 'no more than three off-street parking spaces' for employees and visitors. Importantly, 'Home occupation activities should not be visible from the street, including any outdoor storage of tools, equipment, and/or vehicles, or any advertising signs.' Retail merchandise sales are discouraged because the use must remain secondary to residential use. Certain state-licensed uses, such as licensed family day care for 14 or fewer children, are treated by Minnesota law as a permitted single-family residential use and are not restricted as ordinary home occupations.
Operating a home business that changes the residential character of the home, exceeds three people, parks more than three off-street vehicles, runs out of a garage or shed, or creates street-visible activity or storage can prompt a zoning complaint and enforcement by Planning staff. Persistent violations may require ceasing the use or applying for a different land-use approval.
