Rural home occupations [RHO].a.Purpose and intent. All proposed operations are subject to general standards identified in section 21-55, applicable specific standards in section 21-56, and other pertinent requirements of this chapter. ... (2)Residency. The RHO business must be on or adjacent to the primary residence of the business owner/operator consistent with subsection (3) and located in either the RA or RR district.(3)Building size. The aggregate or maximum square footage for a building(s) used as a RHO is based on the type of road frontage; lot acreage, excluding right-of-way; and zoning district, subject to:a.Location on a parcel containing at least thirty-five (35) feet of state road frontage.1.Ten (10) percent of the lot size with a maximum of twelve thousand (12,000) square feet in the RA district.2.Ten (10) percent of the lot size with a maximum of two thousand (2,000) square feet in the RR district.
Full Breakdown
Section 21-53 establishes RHOs to let residents run business operations from their property while protecting neighbors from adverse impacts, and Section 21-55 sets the criteria that apply to every use listed 'SR' in the Section 21-113 table. Residency comes first: the RHO must operate on or adjacent to the primary residence of the business owner or operator, and it is only allowed in the RA or RR district. Building size is tied to road frontage and lot acreage: on a parcel with at least 35 feet of state road frontage, the RHO building can total 10 percent of the lot size up to a 12,000-square-foot maximum in the RA district, or up to 2,000 square feet in the RR district; without that frontage, both districts cap the same 10 percent formula at 2,000 square feet.
Setbacks then scale with the building's square footage, from 30 feet front and 20 feet side or rear for a building under 2,000 square feet up to 60 feet front and 50 feet side or rear once the building reaches 8,001 to 12,000 square feet. Section 21-55 layers on additional standards: a site plan showing existing and proposed buildings, shielded lighting to prevent glare on neighboring residential property, off-street parking, noise capped at residential levels under the county noise ordinance, rear-yard-only outdoor storage screened under Article IX, and copies of all required state and local licenses before the county issues a zoning permit. If the residency link between the operator and the property changes, Section 21-53(1)d classifies the RHO as nonconforming going forward.
Violations & Fines
Operating an RHO outside the RA or RR district, exceeding the building-size formula, ignoring the size-based setback table, or continuing operation after a change in ownership makes it nonconforming, all count as zoning violations under Rowan County's ordinance. The zoning administrator issues a Section 21-13 notice of violation, with Section 21-14 escalating uncorrected violations from a no-cost warning to $25.00, $50.00, and $100.00 citations for repeated noncompliance, plus injunctive relief through the county attorney for ongoing violations.
