Full Breakdown
Section 3-068 of the Unified Development Code lays out the standards a home business must meet before the public development director will approve it. Subsection (a) caps the number at two home occupations per dwelling and requires the use to sit in a zoning district where home occupations are permitted. Subsection (b) sets the floor area ceiling: the aggregate space devoted to the business, whether inside the house or in an accessory building, cannot exceed 1,000 square feet or 25 percent of the dwelling's gross floor area, whichever number is larger.
Accessory buildings can house a home occupation everywhere except the R-1, R-2 and R-3 zoning districts, per subsection (c). The dwelling has to keep looking like a dwelling: subsection (d) bars any exterior sign of business activity, and subsection (e) bars external alterations inconsistent with residential use. Subsection (k) limits staffing to the dwelling's occupants plus one additional full-time employee or two part-time employees. mail or parcel service, never by truck. Subsection (m) is the approval mechanism itself: an application goes to the public development director, who can require a site plan and a description of the business and may attach conditions to any approval.
An occupational tax license is also required under subsection (n), and the county will not issue one unless the public development department has authorized the home occupation first.
Violations & Fines
Running a home occupation over the floor area cap, with unauthorized employees, or without the public development director's approval violates section 3-068 and is enforced through article 22: a notice of violation can require compliance within a set time, continuing noncompliance is a misdemeanor under section 2230, and the county can seek a civil penalty of $300 to $2,500 per day under section 2232.
