Full Breakdown
Section 34-725(a) sets the location rule: home-based businesses are permitted in all residential zoning districts, and when a dwelling unit is used to conduct one consistent with the section's requirements, a business tax receipt is required. Subsection (b) adds that each business also follows any other restrictions in the individual residential zoning district regulations.
The core test is that the business is secondary to the use of the dwelling for residential purposes and does not change the character of the dwelling unit. The owner must reside at the address registered for the home-based business. No more than two (2) additional employees or contractors who do not reside at the address can be engaged in the business, although additional remote employees that do not work on-site are allowed.
Appearance is regulated from the street. The use of the residential property has to be consistent with the surrounding residential uses, and external modifications made to the residence must conform to the residential character and architectural aesthetics of the neighborhood. No equipment or process can create more noise, vibration, glare, fumes, odors or electrical interference than is allowed at other residential properties. Retail transactions are barred in any accessory building, so a detached garage or shed cannot serve as a sales counter. Vehicles and trailers must be legally parked, and heavy equipment cannot be parked or stored visible from the street or neighboring property. Signs are governed by the City of Jacksonville Beach signage regulations in Division 3 of the LDC.
Violations & Fines
A home-based business that breaks any of the § 34-725(b) standards, or that operates without the required business tax receipt, is a Land Development Code violation. Under § 34-1202 the Planning and Development Department gives written notice with a minimum of ten (10) working days to correct, then a final notice and a hearing before the special magistrate, where the city must prove the violation by a preponderance of the evidence. The City Council or any interested person can also seek an injunction in the Circuit Court of Duval County under § 34-1203.
