Full Breakdown

Section 5.6 of the Methuen Comprehensive Zoning Ordinance sets eight conditions for any home occupation in a residential or multifamily district. One nonresident can be employed, and only when that person is present for a purpose related to the home occupation. The use is carried on strictly within the principal building, with no exterior alterations or accessory buildings on display that are not customary with residential buildings, and no design feature that is not customary in buildings for residential use.

Space is capped in two ways: not more than 25% of the existing gross floor area of the dwelling unit, and not to exceed 700 square feet. No stock-in-trade, commodities or products can occupy space beyond those limits. Goods or wares cannot be displayed where they are visible from the street. Section 5.6(F) also bars any use that becomes objectionable or detrimental to the residential character of the neighborhood through exterior appearance, odor, gas, smoke, dust, noise or disturbance.

Parking: off-street parking must be available for any employees, clients or pupils in accordance with Article VIII.

The definition of HOME OCCUPATION in § 2.2 adds more. It is an accessory use carried on entirely within a dwelling unit, incidental and subordinate to the dwelling use, with no retail sale of merchandise on the premises, carried on only by the occupant of the dwelling unit. Listed examples include beauty parlors, fine art studios, dressmaking, teaching of not more than four pupils simultaneously, real estate, insurance, attorney's, architect's or engineer's offices, internet consulting and sales, and mail-order businesses, so long as there is no exchange of tangible goods on the premises. Barbershops, funeral homes, restaurants, commercial stables or kennels, motor vehicle repair, landscaping yards or contractor's yards and small engine repair are excluded.

The Building Commissioner administers the ordinance under § 10.2, and appeals go to the Board of Appeals, which cannot grant use variances.

Violations & Fines

Under § 10.2 the Building Commissioner investigates complaints, serves a notice of violation and order, and directs the discontinuance of the unlawful use. The penalty for violating any provision of the ordinance or a permit condition is $300 for each offense, and each day a violation continues is a separate offense. Unresolved violations go to court under § 10.7.
