Summary

Kane County allows a home-based business as an accessory "home occupation" use, but only inside the dwelling, run solely by the resident, and never as a retail store, factory or repair shop. The definition also limits customer parking, signage, outside employees, commercial vehicles and noise before the county's zoning enforcement officer will treat the business as lawful.

City-specific rules exist: Aurora, and Elgin have their own zoning & home occupation permits rules that differ from Kane County's county-level regulations. If you live in one of those cities, check the city-specific page instead.

Full Breakdown

Kane County's zoning ordinance defines "home occupation" in Section 25-3-1 as a gainful occupation, profession, business or commercial activity run by the occupant of a dwelling, accessory and secondary to the home's residential use. The definition itself functions as the standard: it must be operated entirely inside the dwelling and only by the person who lives there, which rules out hired staff working on-site. Retail sales, other than by mail, manufacturing and any kind of repair shop are flatly excluded from the home occupation category, so a business built around those activities cannot qualify no matter how small.

The ordinance also folds in traffic and appearance limits: no more than three customer or client cars on the property at once, no more than one person receiving instruction or counseling at a time, and no exterior signage beyond a single two-square-foot sign advertising the business. Any noise, fumes, odor, dust or residential traffic beyond what a normal household generates makes the use a nuisance and takes it out of the home occupation category entirely. Before starting a new home business, Kane County requires the resident to obtain a zoning permit establishing the use is lawful on that property, administered through the county's Development and Community Services Department in Geneva.

A resident who is denied a permit, or who is cited for exceeding the home occupation limits, can appeal the zoning enforcing officer's decision to the Kane County Zoning Board of Appeals. Because the definition doubles as the zoning standard, there is no separate home occupation permit application beyond the general zoning permit process; the enforcing officer simply measures the business against the Section 25-3-1 checklist when a complaint or inspection arises.

Violations & Fines

A home business that hires outside staff, sells retail goods, runs a repair shop, exceeds the three-car or one-person limits, or posts a sign larger than two square feet no longer qualifies as a home occupation. Kane County treats that as a zoning violation under Section 25-4-10-1, carrying a fine of up to $500 per offense, with each week the violation continues charged as a separate offense.

Frequently Asked Questions

What businesses does Kane County allow as a home occupation?
Any gainful occupation or business run entirely inside the dwelling by the resident qualifies, as long as it stays accessory to the home's residential use. Retail sales other than by mail, manufacturing, and repair shops of any kind are excluded, along with any business that hires outside employees who work on site.
Do I need a permit to run a home business in Kane County?
Yes. Kane County requires a zoning permit before establishing any new use of property, including a home occupation, issued through the Development and Community Services Department. An inspector checks the business against the Section 25-3-1 home occupation standards before signing off.
Can I appeal if Kane County denies my home occupation permit?
Yes. A resident denied a permit, or cited for violating the home occupation limits, can appeal the zoning enforcing officer's decision to the Kane County Zoning Board of Appeals, which can reverse, affirm or modify the determination.
