Under Provo City Code Title 14 (Zoning), Chapter 14.41, Section 14.41.040 lists the conditions a home occupation must satisfy. The occupation must be carried on wholly within the residential structure and must remain clearly incidental and secondary to the residential use, with no change to the residential character of the premises and no unreasonable disturbance to the peace and quiet of the neighborhood. Persons who are not bona fide residents of the premises may not be employed on the premises (the conditional-use Major Home Occupation track in Section 14.41.060 can modify this for limited daytime employees). Only one vehicle may be used in association with the home occupation and it must be garaged or stored entirely within a building or structure, with a maximum gross vehicle weight rating of fourteen thousand (14,000) pounds; deliveries are limited to passenger vehicle or parcel/letter carrier service, and semi-tractor/trailer deliveries are prohibited. A Major Home Occupation approved under Section 14.41.060 may use a larger commercial vehicle up to 17,500 pounds GVWR if parked on private property and adequately screened. Certain uses, including medical, dental, and other health professional offices, are excluded from being conducted as home occupations. These local conditions operate alongside Utah Code Section 10-1-203(8), which limits the City's ability to restrict or charge for low-impact home based businesses.
Operating outside any Section 14.41.040 condition - for example, employing non-resident persons on site without a Major Home Occupation approval, using more than one business vehicle, or altering the residential character of the property - is a Title 14 zoning violation. Enforcement is through Provo Code Compliance and may include permit revocation and orders to cease the business.
