040, part of the 2024 Encampment Restriction Ordinance (Ord. 020 as any place where bedding, a sleeping bag, other bedding material, a stove, or fire is placed or maintained for temporary or permanent living, whether or not a tent, lean-to, shack, or other structure is used. Subsection A lists five categories of protected public property where a campsite may not be maintained or occupied: within 1,000 feet of a school serving grades one through 12; a City Park and the area within 1,000 feet of it; land within the Chula Vista Multiple Species Conservation Program (MSCP), naming Otay Valley Regional Park and Sweetwater Valley Regional Park; a Major Transit Stop and area within 1,000 feet, naming the Palomar Street, H Street, and E Street Trolley stops and six Rapid Bus Line 225 stations; and within 1,000 feet of any area the City has designated as a shelter, safe-camping, or safe-parking site.

Subsection B exempts activities expressly authorized by the City Manager or by law, regulation, permit, or governmental order. 050: the City Manager or Police Department may remove personal property, contraband, litter, and waste found at a violating campsite; the City Attorney may bring a civil nuisance-abatement action; and a violation may be charged as a misdemeanor or infraction at the prosecutor's discretion. 040 unless given written notice at least 24 hours before enforcement, with services/resources information provided when possible, unless the City Manager or Police Department reasonably determines the violation creates a dangerous condition or imminent threat to public health or safety, or the County of San Diego or another governmental authority directs abatement, in which case summary abatement without notice is permitted, limited to what is reasonably necessary to remove the threat.
