25(2) sets the standards that apply. 25(2)(l)). 25(2)(n)). Encampments must sit at least 20 feet from the property line of abutting residential uses, be enclosed by sight-obscuring fencing unless the Planning and Building Director waives it for vegetation or topography, direct exterior lighting downward and contain it on site, provide parking for five vehicles, and submit a transportation plan showing service within one-half mile of transit. No more than 100 residents may stay at once, no children under 18 are allowed (the managing agency must contact Child Protective Services if one shows up), and no animals except service animals are permitted.
A written code of conduct enforced by the managing agency must bar drugs, alcohol, weapons, violence, open flames, neighborhood loitering, and must set quiet hours. 30(2)(b), with discretionary 92-day extensions available if the organization documents need and the property owner and sponsor agree. 42: a public informational meeting at least 14 days before startup, mailed notice to property owners and residents within 500 feet, newspaper publication at least seven days before the Planning Official's decision, and a posted Notice of Decision within four business days after the ruling, appealable to the Hearing Examiner.
Violations & Fines
Operating outside the standards in KZC 127.25(2), including the sanitation, waste-disposal, and inspection requirements, or exceeding the 92-day duration without an approved extension, is grounds for the City to revoke or deny renewal of the temporary use permit. KZC 127.15(2) requires the sponsor to sign an irrevocable, notarized statement letting the City summarily abate the encampment and remove all physical evidence of it if not cleared voluntarily, with the sponsor billed for the City's abatement costs. Decisions and enforcement actions may be appealed under KZC 127.45.
