Summary

Brevard bans standing, sitting, or occupying medians, crosswalks, bike lanes, and arterial or collector roadsides where it interferes with traffic, under the county's 2022 Pedestrian Safety Ordinance.

These county ordinances apply to unincorporated areas of Brevard County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

It shall be unlawful for a person to occupy a sidewalk, arterial or collector street, traffic median, crosswalk, bicycle lane, or on-ramps and offramps of Interstate 95 and either: (1) Interfere with or impact the safe and efficient movement of vehicular traffic within any lane of traffic, stopped at a traffic control device, or at an intersection, for any reason except as provided in subsection (b) below.

Full Breakdown

Chapter 106, Article V of the county code makes it unlawful to occupy a sidewalk, arterial or collector street, traffic median, crosswalk, bicycle lane, or an I-95 on-ramp or off-ramp while interfering with vehicular traffic, or to exchange any item with a vehicle occupant in a traffic lane. The ban applies countywide in unincorporated Brevard and yields to any conflicting municipal ordinance inside a city's boundaries. Exceptions cover emergency responders, sidewalk-to-sidewalk activity, and permitted special events.

Violations & Fines

First offense: civil infraction, fine up to $500. Second or later offense: second-degree misdemeanor, fine up to $500 and/or up to 60 days in county jail.

Frequently Asked Questions

Does this apply inside Cocoa or Titusville?
No. It applies countywide in unincorporated Brevard but yields to a conflicting municipal ordinance inside any incorporated city.
Can I stand on a residential street corner?
Yes. The ordinance exempts streets in areas zoned exclusively residential under Chapter 62 of the county code.
Is panhandling itself illegal?
The ordinance targets occupying traffic lanes, medians, and ramps that impede vehicles or exchanging items with drivers, not sidewalk presence alone.
