E. " "Control or Controlled" is defined in subsection (C) as the planned and intentional planting, trimming and cultivation of vegetation, including preventing the unintended spread of viable seed or the vegetative spread of a plant, which for bamboo means keeping running rhizomes from escaping the planted area. 130(A)(4) makes it unlawful for an Owner, Occupant or Agent to allow "Invasive Plants that are not properly Controlled" on their property, and declares any violation a public nuisance subject to abatement and prosecution. The prohibition reaches the strip between the property line and the street or alley centerline, including sidewalks, easements and rights-of-way.

130(B) puts the burden on the Owner, Occupant or Agent to clearly distinguish Controlled Invasive Plants (such as maintained bamboo) from Excessive Growth of Vegetation or uncontrolled Invasive Plants nearby. 140 to enforce the chapter; a written notice of violation gives the property owner ten days to abate before the City can act and assess costs.

Violations & Fines

A City-designated public officer sends a notice of violation by certified mail or personal service; the owner has ten days to control or remove uncontrolled bamboo before the City abates it and bills the cost, plus an administrative fee, as a special assessment under K.S.A. 12-1617e. Separately, Section 7.20.180 makes violation a Municipal Court offense: a fine up to $500 and up to ten days in jail, rising to $250-$500 for a repeat violation within one year, with each day a separate offense.
