New York State maintains a list of prohibited and regulated invasive plant species under 6 NYCRR Part 575. Prohibited species cannot be sold, purchased, transported, introduced, or propagated. Regulated species require specific management protocols. NYC Parks also maintains an invasive species management program.
New York State Environmental Conservation Law and 6 NYCRR Part 575 establish two categories: Prohibited species (cannot be knowingly possessed with intent to sell, imported, purchased, transported, introduced, or propagated) and Regulated species (can be sold with disclosure requirements and management protocols). Key prohibited species include: Japanese knotweed (Fallopia japonica), Giant hogweed (Heracleum mantegazzianum), Water chestnut (Trapa natans), Porcelain berry (Ampelopsis brevipedunculata), and certain running bamboo species. NYC residents can report invasive plant species through the NYC311 portal under the category for Invasive Plant Species (KA-03169). NYC Parks actively manages invasive species in parklands and natural areas. The NYC Urban Forest Agenda includes invasive species management as a priority.
Knowingly selling, transporting, or introducing prohibited invasive species is subject to civil penalties under New York Environmental Conservation Law. Property owners may be required to manage regulated species according to state guidelines. NYC may issue violations through Parks Department enforcement.
