Under Mahwah's property maintenance code (Chapter 10), all premises and exterior property must be maintained free from weeds or plant growth taller than 10 inches. Weeds are defined broadly as grasses, annual plants, and vegetation other than trees or shrubs, but cultivated flowers and gardens are excluded. Noxious weeds are prohibited regardless of height. The Planning, Zoning & Property Maintenance Department enforces compliance and may issue notices of violation requiring corrective action.
Property owners receiving violation notices must mow or remove overgrown vegetation. Continued non-compliance can result in municipal court summonses and fines, plus the Township performing abatement at the owner's cost.
