Mahwah prohibits noxious weeds on all property and treats vegetation over 10 inches as a property maintenance violation subject to abatement.
Mahwah's property maintenance ordinance (Chapter 10) prohibits noxious weeds on all premises regardless of height and bars general weed or plant growth in excess of 10 inches. Weeds include all grasses, annual plants, and vegetation other than trees or shrubs, except cultivated flowers and gardens. The Planning, Zoning & Property Maintenance Department investigates complaints, issues violation notices, and may direct abatement when owners fail to comply. Vacant lots, foreclosure properties, and rental units are subject to the same standards.
Failure to remove noxious weeds or overgrown vegetation after notice can result in municipal fines, recorded liens for abatement costs, and re-inspection fees. Repeat violations may escalate penalties.
