Spotsylvania County, VA Landscaping Rules: Rainwater Harvesting (2026)

The Mixed Use (MU) district's development standards, Sec. 23-6.28.4(4), list the setback encroachments the county allows once a lot has met its minimum yard requirements. Alongside sustainable energy systems such as solar panels and wind turbines, the ordinance names rainwater collection or harvesting systems as a mechanical/utility encroachment that may extend into a required rear or side setback, so long as the equipment stays at least three feet back from the vertical plane of the lot line. That three-foot buffer is the same clearance the county requires for solar panels and wind turbines under the adjacent subsection, but it is more generous than the five-foot clearance required for HVAC units and security lighting listed just above it.

The same section's height-encroachment rules, Sec. 23-6.28.4(9)(b), separately address rain barrels as an accessory structure. Rainwater collection or harvesting systems, along with items such as flagpoles, garden structures, and sustainable energy systems, may exceed the MU district's maximum building height by as much as twelve feet without triggering a special use or variance, because the ordinance treats an accessory structure in that height range as automatically permitted rather than an unlisted height encroachment, which the section prohibits unless the zoning administrator finds it comparable to a listed item.

Because these allowances are written into the Mixed Use district's own development-standards article, they apply only to lots zoned MU-1 through MU-5; the ordinance does not extend the same encroachment or height allowance to Spotsylvania's other residential or agricultural zoning districts.
