Summary

Miami-Dade County's year-round landscape irrigation rule sets fixed watering days by address and bans irrigation from 10 a.m. to 4 p.m. daily, but rain barrels, cisterns and similar rain-harvesting devices are carved out entirely. County Code § 32-8.2(d)(ii)(6) lets any landscaping be watered with a rain barrel, cistern or rain-harvesting device, plus low-volume or micro-irrigation and hand watering, on any day or at any hour, with no permit needed.

City-specific rules exist: Doral, Hialeah, Homestead, Miami Beach, Miami, Miami Gardens, and North Miami have their own rainwater harvesting rules that differ from Miami-Dade County's county-level regulations. If you live in one of those cities, check the city-specific page instead.

(6)Any landscaping may be irrigated using low volume irrigation, micro-irrigation, or low-volume hand watering methods including but not limited to the use of rain barrels, cisterns, or other similar rain-harvesting devices without regard to the watering days or times allowed pursuant to this section.

Full Breakdown

Section 32-8.2 of the Code of Miami-Dade County imposes "mandatory year-round landscape irrigation conservation measures" as a minimum standard that "shall apply to both the incorporated and unincorporated areas of the County" (§32-8.2(a)); in unincorporated Miami-Dade the County's Water and Sewer Department enforces it directly, while each of the 34 municipalities enforces it within its own limits unless it asks the County to take over, and any municipality may adopt its own ordinance as long as it is "equivalent to or more stringent." The baseline schedule bans irrigation of existing landscaping "between the hours of 10:00 a.m. and 4:00 p.m. daily" and assigns watering days by address: even-numbered addresses may irrigate only Thursday and/or Sunday, odd-numbered addresses only Wednesday and/or Saturday (§32-8.2(d)(ii)(1)(a), (c), (d)).

Rainwater harvesting is where the County relaxes that grid entirely. Under §32-8.2(d)(ii)(6), "any landscaping may be irrigated using low volume irrigation, micro-irrigation, or low-volume hand watering methods including but not limited to the use of rain barrels, cisterns, or other similar rain-harvesting devices without regard to the watering days or times allowed pursuant to this section." No permit, registration or fee attaches to installing or using a rain barrel or cistern under this section, and the exemption applies countywide to residential, commercial, institutional and governmental landscaping alike.

A property owner who cannot make the standard schedule work for other reasons can instead apply to the Director of the Water and Sewer Department for an "alternate method of compliance" under §32-8.2(g): a free application, a written decision within 21 days, and a right to appeal to the Director within 30 days of denial. Any water shortage or water shortage emergency declared by the South Florida Water Management District under Chapter 40E-21, F.A.C. overrides even this exemption for its duration (§32-8.2(h)).

Violations & Fines

Violating the general watering-day schedule in §32-8.2(d) is enforced under Chapter 8CC's civil penalty schedule (§32-8.2(f)), with each day of noncompliance a separate offense; officers and code inspectors may issue one written warning under §32-8.2(e)(2) before citing a violator. Because rain barrels, cisterns and low-volume rain-harvesting devices are excluded from the restricted-day rule by §32-8.2(d)(ii)(6), using one to water on an otherwise off-limits day is not a violation and carries no exposure under this section.

Frequently Asked Questions

Do I need a permit to install a rain barrel in Miami-Dade County?
No. Section 32-8.2(d)(ii)(6) of the County Code lets any landscaping be irrigated with rain barrels, cisterns or similar rain-harvesting devices "without regard to the watering days or times allowed pursuant to this section," and the County imposes no permit or fee for installing or using one. The exemption applies countywide, in both incorporated municipalities and unincorporated Miami-Dade.
Can I use my rain barrel on a day my address isn't allowed to water?
Yes. The standard schedule limits even-numbered addresses to Thursday/Sunday and odd-numbered addresses to Wednesday/Saturday under §32-8.2(d)(ii)(1), but §32-8.2(d)(ii)(6) exempts rain barrels, cisterns and other low-volume or micro-irrigation methods from those day and hour limits entirely, so you can hand-water from a rain barrel any day, including during the 10 a.m. to 4 p.m. restricted window.
Does the rain barrel exemption still apply during a declared water shortage?
Not automatically. Section 32-8.2(h) states that a water shortage or water shortage emergency declared by the South Florida Water Management District under Chapter 40E-21, F.A.C. "shall supersede this section for the duration of the applicable water shortage declaration," so the District's emergency order controls and can restrict even low-volume and rain-harvesting watering during that period.
What happens if I violate the regular watering schedule?
Enforcement runs through Chapter 8CC's civil penalty schedule referenced in §32-8.2(f), and each day of a continuing violation counts as a separate offense. Miami-Dade code inspectors and law enforcement officers may first issue one written warning under §32-8.2(e)(2) before penalties apply, and the County can also seek injunctive relief for repeat violations.
