Three overlapping rules cover tree removal in Bellingham. (A) Emergency Landmark Tree Ordinance — adopted May 20, 2024 and extended four times, most recently on March 9, 2026, remaining in effect through September 2026 or until City Council amends. Any tree with a trunk diameter of 36 inches or greater at breast height (DBH) in healthy growing condition is automatically designated a 'landmark tree' (black cottonwood is excluded). Removal, damage, or harm to a landmark tree requires City approval; the Director of Planning and Community Development may approve removal only if (i) necessary for reasonable property use with demonstrated alternatives, (ii) required for utilities or easements predating the ordinance, or (iii) the tree is hazardous. (B) BMC Chapter 16.60 (Land Clearing) defines a 'significant tree' as a tree of any species six inches in diameter or greater at breast height. Where land clearing is associated with a building, street, or utility permit, the applicant must submit a tree retention plan identifying the species and size of all significant trees on site, which trees will be removed and which preserved, and the method by which the critical root zone of retained trees will be protected during construction (e.g., fencing). Significant trees that must be removed shall be replaced at a ratio determined by the Planning and Community Development Department (PCDD). (C) BMC 13.40 — no person may remove a tree in a planting strip, improved right-of-way, or other public place without a Street Tree Permit. Within the Lake Whatcom watershed, BMC 16.80 imposes additional vegetation retention (see Native Plants).
Violation of the Emergency Landmark Tree Ordinance carries a minimum fine of $800 and a maximum of $5,000 per violation.
