UDC Section 6.1 regulates the clearing of tree and wood vegetation in unincorporated Shelby County and the City of Memphis, adopted February 26, 2001. Except for exempt situations, it is unlawful to remove an existing tree without a tree removal permit, an equivalent alternative planting plan conforming to the tree removal matrix, a replanting development plan, or a waiver (Sub-Section 6.1.2B). Ten to 45 working days before removal, a notice of intent must be filed with the Zoning Administrator, and a tree survey is generally required. Exemptions cover residential lots with an existing dwelling of ten acres or less and removal of no more than five trees per acre.
Commencing tree removal on a non-exempt parcel without an approved permit, alternative, or waiver violates UDC Section 6.1. Enforcement by the Division of Planning and Development can include stop-work orders, required replanting under the tree removal matrix, and permit denial.
