The Code of Shelby County authorizes the county to compel owners of unincorporated property to cut rank weeds, grasses, and underbrush deemed a health or traffic hazard, enforced by the Health Department through notice, county cutting, liens, and fines.
Under Chapter 16, Article IV, Division 2 of the Code of Shelby County, the county may regulate the cutting of rank weeds, grasses, or other underbrush that constitute a health or traffic hazard, and compel owners of property outside incorporated municipalities to cut or destroy them (Sec. 16-111). The Memphis/Shelby County Health Department serves written notice, and the owner must clean, clear, or cut within ten days (Sec. 16-113). If the owner fails, the county may enter and cut, and re-enter for 365 days without further notice. Unpaid removal costs become a lien certified to the county trustee (Sec. 16-114). Large parcels over four acres and active agricultural uses are exempt unless they pose a traffic hazard (Sec. 16-116).
An owner who fails to remedy weeds after notice may be summoned to Shelby County General Sessions Environmental Court under Section 16-115. On a finding of non-compliance the court may fine up to $50 per day plus costs.
