Mecklenburg County follows NC common-law self-help rules for tree trimming. A property owner may trim branches and roots that cross the property line up to the boundary, at their own expense, without harming the tree. HOAs commonly impose stricter rules.
North Carolina follows the Massachusetts Rule (self-help): an adjoining landowner may cut overhanging branches and encroaching roots back to the property line at their own expense. You may not enter the neighbor's property without permission, and you are liable if trimming kills the tree. For trees in the public right-of-way, Charlotte-Mecklenburg Storm Water Services or the municipal arborist must authorize work. Heritage trees and regulated trees under the Mecklenburg County Tree Ordinance may require a permit to prune beyond ANSI A300 standards.
