Clayton County's Tree Protection Ordinance, Chapter 86, Article II, applies to rezonings, land-disturbance permits, and development plans in the unincorporated county, not to ordinary trimming of a homeowner's trees. Section 86-66 confirms the ordinance does not relieve owners of the duty to keep trees and shrubs on their property in a safe condition. Trees the developer preserved or planted to meet density standards cannot be removed within two years of the certificate of occupancy. Cities enforce their own tree rules within their limits.
No penalty applies to routine pruning of your own trees. Damaging or removing protected or development-required trees can bring fines up to $1,000 per day under section 86-67, plus mandatory replacement.
