Full Breakdown

Section 82-15 of the Burleson Code of Ordinances, adopted by the Burleson City Council in Ord. No. CSO#130-01-2015, sets a permanent twice-weekly irrigation schedule for the City of Burleson. It applies to irrigation using potable water from the City of Burleson's water distribution system, unless a more restrictive measure applies under section 82-14, the drought contingency section. Irrigation from alternative water sources such as a well or reclaimed or reused water is specifically excluded.

The watering day depends on the street address. Residential addresses ending in 0, 2, 4, 6 or 8 water on Wednesdays and Saturdays. Residential addresses ending in 1, 3, 5, 7 or 9 water on Thursdays and Sundays. All non-residential watering locations, which the code lists as apartment complexes, businesses, industries, parks and medians, water on Tuesdays and Fridays. No watering of any lawn or landscape is allowed between 10:00 a.m. and 6:00 p.m. on any day, including a person's assigned day. Hand watering and soaker hoses are exempt from both the hour limit and the day schedule.

Subsection (c) adds waste rules for the irrigation system itself. It is an offense to operate a system that sends a substantial amount of water onto impervious areas so that a constant stream overflows onto a street or other drainage area, that runs during any form of precipitation or during freezing weather, that has any broken or missing sprinkler heads, or that has not been maintained in a manner that prevents the waste of water.

Subsection (d) gives affirmative defenses for watering done to establish hydro-mulch, grass sod or grass seed, for dust control of a sports field, or for the maintenance, repair or testing of an irrigation system. Those defenses last only for 30 consecutive days or less. After the 30th consecutive day, the person is subject to applicable criminal penalties.

Section 82-14 sits next to this rule and can tighten it. The city manager or a designated representative can start, upgrade or end drought stages under the adopted plan, announced by newspaper, press release, utility bill insert, the city newsletter or the city website and public access channel. A stage started because of excessive demand stays in force through September 30 of that year unless the city manager ends it sooner.

Violations & Fines

Section 82-15 declares each prohibited act an offense but prints no fine of its own. Where a measure is ordered under the drought plan, section 82-14(g) sets a written warning for a first offense, a fine of not less than $250.00 for a second, not less than $500.00 for a third, and not less than $750.00 for each later offense. Each day is a new and separate violation, and the city manager or a designated representative can authorize discontinuing water service at the premises, with restoration only after the reconnection fee and any outstanding fines are paid.

Frequently Asked Questions

Which days can I water my lawn in the City of Burleson?
It depends on your address. Residential addresses ending in an even number water on Wednesdays and Saturdays, and residential addresses ending in an odd number water on Thursdays and Sundays. Apartment complexes, businesses, industries, parks and medians water on Tuesdays and Fridays. Watering is never allowed between 10:00 a.m. and 6:00 p.m.
Does the Burleson watering schedule apply to hand watering?
No. Section 82-15(b) opens with the words 'Except for hand watering and the use of soaker hoses,' so hand watering and soaker hoses are outside both the twice-weekly day schedule and the 10:00 a.m. to 6:00 p.m. ban. Sprinklers and other irrigation systems fed by city water must follow the schedule.
Do the rules cover a private well in Burleson?
No. Section 82-15(a) says irrigation using alternative water sources such as a well or reclaimed or reused water is specifically excluded from the irrigation restrictions of that section. The schedule applies to irrigation using potable water from the City of Burleson's water distribution system, subject to any stricter drought stage under section 82-14.
Can I water more often when I lay new sod in Burleson?
Watering to establish hydro-mulch, grass sod or grass seed is an affirmative defense to prosecution under section 82-15(d), not a blanket exemption. The defense holds only if the activity runs for 30 consecutive days or less. After the 30th consecutive day, a person found in violation is subject to applicable criminal penalties.
Can Burleson tighten the watering rules during a drought?
Yes. Section 82-14 lets the city manager or a designated representative define trigger conditions, move the drought plan up or down a stage, and end it. Notice goes out by newspaper, press release, bill insert, newsletter or the city website. A stage started for excessive demand stays in effect through September 30 unless ended earlier.
