Under the Montana County Noxious Weed Management Act (MCA Title 7, Chapter 22, Part 21), controlling designated noxious weeds is a legal duty, not optional. State law defines noxious weeds as exotic plant species that render land unfit for agriculture, forestry, livestock, wildlife, or other beneficial uses, designated statewide by the Department of Agriculture or as district weeds by a county board. The Yellowstone County Weed District enforces the statewide noxious weed list, offers a Herbicide/Biocontrol Cost-Share Program (50% up to $500), and helps landowners write management plans. A landowner complies by following the district program or maintaining an active noxious-weed management agreement.
Permitting a noxious weed to propagate or go to seed is unlawful under MCA 7-22-2116. The county weed board may issue a notice to control and, if ignored, treat the land and assess costs against the landowner.
