Two layers apply: statewide, IC 15-16-8-3 requires every Indiana landowner to destroy detrimental plants; locally, Elkhart County's Weed and Rank Vegetation Control Ordinance caps plant life at 8 inches on unincorporated residential parcels of 3 acres or less.
Indiana defines a short list of detrimental plants at IC 15-16-8-1, including Canada thistle, Johnson grass, and, in residential areas, noxious weeds and rank vegetation, and IC 15-16-8-3 obligates every landowner to destroy them by cutting, mowing, or chemical treatment before they mature; a township trustee can order abatement. On top of that state duty, Elkhart County's Ordinance No. 2013-220 sets a concrete 8-inch trigger for unincorporated residential parcels around Middlebury, Dunlap, and Bristol, with exemptions for cultivated landscaping, gardens, and agricultural crops. The cities of Elkhart, Goshen, and Nappanee enforce their own municipal weed codes within their limits.
The county Zoning Administrator gives written notice and 10 business days to cut, then mows and bills removal plus administrative costs to the tax duplicate; civil penalties reach $2,500 per day. State detrimental-plant duties are enforced by the township trustee.
