Tomball treats excessive weeds and rank vegetation as a public nuisance under Chapter 34 of the Code of Ordinances. Weeds, brush, rubbish, and other objectionable or unsanitary matter must be removed or maintained to prevent conditions that harbor vermin or create fire hazards. The 12-inch vegetation height limit applies to all grass and weed species. Code enforcement officers may initiate action based on complaints from neighbors or through routine area inspections. After identifying a violation, the city sends written notice to the property owner (and to the occupant if different) giving 10 days to correct the condition. If the owner cannot be located, notice may be posted on the property and published. The city maintains a list of chronic violators and may abate conditions on properties that have been in violation within the preceding 12 months without additional notice. Vacant lots are subject to the same standards as occupied properties and are frequently the subject of complaints.
First offense receives written notice with 10 days to comply. If not corrected, the city performs abatement and bills the property owner, with costs typically ranging from $150 to $500 depending on the property size and amount of work. Administrative fees are added to abatement costs. Unpaid charges become a lien on the property. Criminal penalties up to $500 per offense may also apply. Each day of continued violation constitutes a separate offense.
