Tuolumne County adopted a Hazardous Vegetation Ordinance requiring vegetation maintenance on both developed and vacant parcels. CAL FIRE handles weed and brush complaints in the State Responsibility Area, which covers most of the county.
Tuolumne County's Hazardous Vegetation Ordinance requires property owners in unincorporated areas to reduce hazardous vegetation on property adjacent to roads, driveways, and road easements. The ordinance also covers entire undeveloped parcels and vacant lots not under Williamson Act agricultural contracts. This goes beyond state PRC Β§4291 which only applies to developed parcels with structures. Weed and brush complaints are referred to CAL FIRE, which has jurisdiction in the State Responsibility Area covering most of the county. California Health & Safety Code Β§14875 and Government Code Β§39560-39588 provide additional authority for weed abatement. The county can abate hazardous vegetation and place liens on properties for the cost.
County abatement: costs billed to owner plus administrative fees, recorded as lien. PRC Β§4291: up to $1,000/day fine. CAL FIRE enforcement in SRA areas.
